INM Regularization in Mexico: Overstays, Expired Cards and Fines

Mexico's Migration Law lets foreigners already in the country fix an irregular status through INM. Which route fits an overstay, an expired card or a family tie, and what it costs.

Foreigners in Mexico whose visitor permit has run out, whose resident card has expired, or who worked without permission can apply to the National Migration Institute (INM) for regularization (regularización migratoria). Mexico’s Migration Law sets the routes and the fines: 20 to 100 days of the reference unit for overstays and unauthorized work, 20 to 40 for family ties, and none for humanitarian cases.

Who can regularize their status in Mexico?

Article 132 of the Migration Law (Ley de Migración) gives foreigners the right to ask for regularization when they have no papers proving a regular status, when their papers have expired, or when they no longer meet the conditions of the status they were given. Articles 133 and 134 then group people into three practical routes:

  • Expired document or unauthorized activity. A visitor who stayed past the authorized period, or anyone doing work their status does not allow (Article 134).
  • Family tie. The spouse or partner (concubino) of a Mexican or of a foreign resident, or the parent, child, legal representative or guardian of a Mexican or of a foreign resident (Article 133, sections I and II).
  • Humanitarian grounds. Victims or witnesses of a serious crime committed in Mexico, people whose vulnerability makes removal difficult or impossible, and children in an international child abduction case (Article 133, sections III to V).

INM decides each case. Regularization ends with INM granting the condition of stay that fits the route, so it is the door back into the normal system of visitor and resident cards, not a status of its own.

Is there a deadline for overstayed tourists?

Yes. A foreigner who entered legally and stayed past the authorized period must file within 60 calendar days after that period ended, under Article 134, section I. After that window, the overstay route in Article 134 no longer applies on its own terms, and the person needs another legal basis, such as a family tie, to file.

The same article covers people doing activities their status does not allow, for example a visitor working for a Mexican employer. That case has no fixed filing window in the article, but the fine range is the same.

How much are the regularization fines?

The Migration Law still writes these fines in days of minimum wage, but since the 2016 de-indexing reform they are calculated with the UMA (Unidad de Medida y Actualización), worth MXN 117.31 a day as of November 2026. Our guide to the UMA explains the conversion.

Route Legal basis Fine range In pesos, as of November 2026
Overstay or unauthorized activity Articles 134 and 146 20 to 100 days About MXN 2,346 to MXN 11,731
Spouse, partner, parent, child or guardian Articles 133 (I, II) and 145 20 to 40 days About MXN 2,346 to MXN 4,692
Victim, witness, vulnerability, child restitution Articles 133 (III to V) and 145 No fine MXN 0

INM sets the exact fine within the range. The fine is separate from the government fee for studying the application.

What does the application cost and how long does it take?

The gob.mx pages for the overstay route and the family route list a variable fee from MXN 1,847 to MXN 25,058, paid when you file, as of November 2026. The final amount depends on the document INM ends up issuing. The humanitarian route is free. All three list a response time of 30 calendar days and a document validity of one year.

The official procedure pages are on gob.mx: regularization for an expired document or unauthorized activities (homoclave INM-03-002-D) and regularization through a family tie (INM-03-002-E). The humanitarian route is INM-03-002-A.

What documents does INM ask for?

Every route starts with a valid passport or official identity document showing name, nationality, date of birth and a photo. The rest depends on the route:

Route Main documents on the gob.mx page
Expired document or unauthorized activity Passport; your FMM entry record, visitor card or temporary resident card; proof of the fine payment; proof of the fee payment; a document proving the situation; INM application form
Family tie Passport; any earlier immigration document; marriage certificate or proof of partnership plus a letter signed by both partners giving the shared address, or a birth certificate or custody ruling for parents and children; ID of the Mexican or the resident’s card; fee receipt; fine receipt if one applies
Humanitarian grounds Passport or other ID; an official document proving the situation, such as a prosecutor’s record for a crime victim, a COMAR certificate for a refugee applicant or an SRE receipt for an asylum request; INM application form

Foreign birth and marriage certificates usually need an apostille and a Spanish translation. Ask the INM office before you book, since requirements can be read differently at the counter.

How do you apply at INM in Mexico City?

  1. Fill in the residency procedure form (formato para solicitar trámite migratorio de estancia) on INM’s online procedures microsite, choosing the regularization type, then print and sign it.
  2. Gather the documents for your route, with copies. Bring proof of the date your permit or card expired.
  3. Pay the fee at a bank with the official payment form when INM asks for it. For the overstay and family routes, the fine is set by INM and paid separately.
  4. Go to the INM office that covers your address with the form and documents. In Mexico City, that is the city’s INM office for residency procedures.
  5. Keep the receipt with your procedure number (NUT) and follow the case online. If INM approves, it issues the visitor or resident status that fits your route, and you go back for fingerprints and the card.

Once you hold a card again, the normal rules apply: renewing a temporary resident card on time and reporting any move through the INM change of address notice within 90 days.

Which route fits a family with a Mexican spouse or child?

The family route is usually the stronger path for someone married to a Mexican, living with a Mexican partner, or the parent of a Mexican child, because the fine range is lower (20 to 40 days) and it does not depend on the 60-day overstay window. Family ties also open the standard family unity residency, which many people use once their status is regular again.

This article explains how the Migration Law and INM’s procedures work. It is not legal advice; INM decides each case, and an immigration lawyer can tell you which route fits yours.

Bottom line

Check the date your permit or card expired and count 60 calendar days if you came in as a visitor. Pick the route on gob.mx that matches your situation, collect apostilled family documents early, and file at INM before the gap grows. Keep every receipt with your passport.

FAQ

Can a tourist who overstayed become a resident without leaving Mexico?

Only through a legal basis that allows it, such as a family tie to a Mexican or a resident, or humanitarian grounds. The overstay route in Article 134 regularizes the stay itself; INM grants the condition of stay that fits the case.

Is regularization the same as renewing an expired resident card?

No. Renewal applies while the card is valid. Once a card has expired, INM may treat the case as regularization, with a fine, so file renewals before the expiry date.

Do humanitarian applicants pay anything?

No. The gob.mx page for humanitarian regularization lists the procedure as free, and Article 145 of the Migration Law exempts victims, witnesses, vulnerable people and children in restitution cases from the fine.

Where do I pay the fine?

INM sets the amount and gives you the payment details. You pay at a bank and bring the receipt, which is one of the listed requirements for the overstay route.
