CDMX Prosecutors Tried 7 Times to Summon Vadhir Derbez in Rape Case
Mexico City prosecutors say an amparo voided the arrest warrant for Vadhir Derbez in a Coyoacán rape case, but the investigation stays open. What changed.

Mexico City’s prosecutors say they made at least 7 attempts to serve a summons on actor and singer Vadhir Derbez at 6 different addresses, without reaching him, in an open rape investigation tied to events alleged in April 2026 in the Coyoacán borough. The Fiscalía General de Justicia de la Ciudad de México (FGJCDMX, the city’s attorney general’s office) laid out the case in a statement published Friday, Nov. 6.
The office said it had obtained an arrest warrant against Derbez, the son of Eugenio Derbez, but a judge’s ruling on an amparo (a constitutional appeal that can block government acts) left the warrant without effect. He can now face the criminal process without being detained. Prosecutors stressed that the investigation is still active and that he can be called to an initial hearing.
What the city prosecutors said
According to the statement, as reported by El Financiero, El Informador and Ovaciones, the FGJCDMX gathered enough evidence to take the case before a supervising judge, known in Mexico as a juez de control. That evidence is what produced the arrest warrant on a rape charge.
The amparo was filed by Derbez’s legal team, El Informador reported. Under the ruling, he keeps the right to be formally summoned to an initial hearing where charges are presented, called an audiencia inicial de formulación de imputación, instead of being picked up by police. The office said this outcome does not close the case and does not clear him of the accusation.
Prosecutors also pointed to a gap between public statements and actions. Derbez and his lawyers have said in public that they are willing to cooperate with the authorities, the office noted, yet he has not appeared before the institution. The repeated in-person summons attempts at different homes have not resulted in an official notification.
The complaint filed in April
The case began with a complaint filed on April 2, 2026, before the city’s sex crimes investigation unit by a 19-year-old model from the United States. She accused Derbez of sexually assaulting her on the last day of filming a music video at a location in Coyoacán, El Financiero reported.
According to her complaint, he took her to a dressing room, where he allegedly had physical contact with her without her consent. She then went to the authorities and was granted protective measures.
The accusation became public in May 2026. Derbez denied it in a television interview on the program De Primera Mano with journalist Gustavo Adolfo Infante, with his legal team at his side. He said he knew the woman because she modeled in one of his music videos, but denied that the two were ever alone during filming, and said there were enough witnesses on set. He told the program his side has evidence that the assault did not happen.
A second complaint at the federal level
The city statement came after a separate move announced this week. On Wednesday, Nov. 4, the law firm Vega Mac Gregor Arellano held a press conference to request a meeting with Ernestina Godoy, head of the Fiscalía General de la República (FGR, Mexico’s federal attorney general’s office), to follow up on a rape complaint against the actor.
Attorney Leopoldo Vega later told reporters that this complaint comes from a different woman, not the model who went to the city prosecutors. The FGJCDMX said its own file is separate and independent from the complaint announced before the FGR.
What it means for the case
The amparo affects how Derbez would arrive in court, and prosecutors say the case continues. Without an active warrant, the next step depends on prosecutors serving him with a summons for the initial hearing. Their account of repeated failed attempts at multiple addresses explains why that hearing has not yet taken place.
For people following how Mexico City handles sexual assault complaints, the statement shows the path such a case takes: a complaint to the specialized unit, protective measures for the complainant, evidence presented to a judge, a warrant, and then a legal challenge by the accused. The FGJCDMX said it will keep carrying out the steps needed to clarify the facts and guarantee the complainant full access to justice.
What happens next
The city prosecutors said they will continue trying to get Derbez to appear so the criminal process can move ahead under the law. They also reminded the public that, under current law, he is presumed innocent at every stage of the process until a competent court issues a conviction. No date for the initial hearing has been disclosed.
